Previous consultations

    We advise on the process of Prior Consultation focused on legally shielding companies before and during the development of the process, based on compliance with current regulations and case law, respecting the rights of ethnic communities, aiming to achieve the social viability of the project, work or activity.

    Among the services we provide are the following:

    • Processing of the request for determination of origin and opportunity of the previous consultation for the execution of projects, works or activities before the Technical Sub-direction of Previous Consultation.
    • Accompaniment in the visit to verify the origin of the prior consultation carried out by the Technical Sub-directorate of Prior Consultation.
    • Legal analysis of the Administrative Act by which the presence and opportunity of the prior consultation for the execution of projects, works or activities issued by the Technical Sub-directorate of Prior Consultation is determined, with the purpose of determining the origin or not of the replacement resource and, if required, to file it before the Direction of the National Authority of Prior Consultation.
    • Training for the personnel of the company interested in carrying out the project and its contractors on the process of prior consultation and its regulations.
    • Advice during the planning of the procedure to follow for the execution of the previous consultation, verifying the fulfillment of the normative in force and the jurisprudence.
